29 CFR 1926.451(b)(1)(i): Each platform unit (e.g., scaffold plank, fabricated plank, fabricated deck, or fabricated platform) was not installed so that the space between adjacent units and the space between the platform and the uprights were no more than 1 inch (2.5 cm) wide, except where the employer can demonstrate that a wider space is necessary. a) New residential construction; lot 128; exterior wall: On or about 7/16/2020, and at times prior, the employer exposed employees to falls of 18 feet from the work platform of a tubular welded scaffold, in that the scaffolding working platforms were not fully planked while conducting masonry activities.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Crossbraces were used as a means of access. a) New residential construction; lot 128; exterior wall: On or about 7/16/2020, and at times prior, the employer exposed employees to falls of 18 feet from the side rails of a tubular welded scaffold, in that there was no safe means of access to the scaffold working platforms while conducting masonry activities.

29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section: a) New residential construction; lot 128; exterior wall: On or about 7/16/2020, and at times prior, the employer exposed employees to falls of 18 feet from the work platform of a tubular welded scaffold, in that a fall protection system and/or complete guard railing was not provided while conducting masonry activities. The scaffolding was open at all ends.
