29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.     a. On or about July 15, 2020, at the residential job site, Lot 807, in the Pulte Homes - Jerome Village Community, the employer failed to maintain a safety program to ensure hazard detection and correction including, but not limited to, ladder safety and fall protection.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.   Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.   a. On or about July 15, 2020, at the residential job site, Lot 807, in the Pulte Homes - Jerome Village Community, employees involved in roofing activities on the porch/garage roof were not protected against exterior falls, thereby exposing employees to a fall hazard ranging from 11 feet, 10.75 inches to 15 feet, 11.25 inches.   b. On or about July 15, 2020, at the residential job site, Lot 807, in the Pulte Homes - Jerome Village Community, an employee involved in roofing activities on the main roof was not protected against exterior falls, thereby exposing the employee to a fall hazard greater than 16 feet, 5.5 inches.

29 CFR 1926.1053(a)(14): The minimum perpendicular clearance between the center line of fixed ladder rungs, cleats, and steps, and any obstruction on the climbing side of the ladder shall be 30 inches (76 cm), except as provided in paragraph (a)(15) of this section.   a. On or about July 15, 2020, at the residential job site, Lot 807, in the Pulte Homes - Jerome Village Community, the employer did not ensure that the Werner 36 ft. aluminum extension ladder (model: D1336-2) used to access the various roof elevations was not obstructed on the climbing side with two compressed air lines and debris, thereby exposing an employee to a fall hazard greater than 11 feet, 10.75 inches.
