29 CFR 1926.451(f)(4): Part(s) of a scaffold that were damaged or weakened, such that the scaffold's strength was less than that required by paragraph (a) of this section, were not immediately repaired, replaced, braced to meet those provisions, nor removed from service until repaired. On or about July 17, 2020, and at times prior thereto, employees were performing masonry activities on a scaffold system where the employer did not ensure weakened components on the scaffold were repaired or replaced prior to allowing employees to work from the scaffold system exposing the employees to fall hazards.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards: On or about July 17, 2020, and at time prior thereto, the employer did not ensure all employees working from a tubular framed scaffold system were properly trained to work from the scaffold, such as but not limited to, an employee working on the job site for the first time.
