29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of the excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. a) On or about July 15, 2020, and at times prior thereto, the excavated soil from the trench was placed directly on the wall of a 6.0 foot deep trench where employees were drilling epoxy and rebar in preparation for a concrete pour, exposing employees to overhead and crushing hazards. Abatement certification AND documentation are required for this item.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. Inspections were not conducted by the competent person prior to the start of work and as needed throughout the shift. a) On or about July 15, 2020, and at times prior thereto, the employer did not ensure a "competent person" inspected trenches and excavations prior to the start of work and as needed throughout the shift. Employees were drilling epoxy and rebar in preparation for a concrete pour in a trench at a depth of approximately 6.0 feet. Employees did not have the protection of sloping, benching and/or other engineering controls such as an appropriate trench box throughout the work process. Inspections were not completed for the potential cave-in hazards on the site. Abatement certification AND documentation are required for this item.
