29 CFR 1910.272(d): The employer did not develop and implement an emergency action plan meeting the requirements contained in 1910.38(a): a) Ottawa Grain and Feed Company, Inc. located at 206 South Oak Street in Ottawa, Ohio; On or about July 21, 2020 the employer did not develop and implement an emergency action plan as outlined in 29 CFR 1910.38. Employees were exposed to entrapment and engulfment hazards in that the company's emergency action plan did not identify the procedures to be taken in the event of a grain entrapment or engulfment.

29 CFR 1910.272(g)(1)(ii): Prior to entry, all mechanical, electrical, hydraulic, and pneumatic equipment which presented a danger to employees inside grain storage structures in the grain handling facility were not disconnected, locked out and tagged, blocked-off, or otherwise prevented from operating by other equally effective means or methods. a) Ottawa Grain and Feed Company, Inc. located at 206 South Oak Street in Ottawa, Ohio; On or about July 21, 2020 the employer did not ensure equipment which presents a hazard to employees inside of grain storage structures were de-energized and prevented from operating. Employees were exposed to engulfment hazards in that the infeed grain conveyor gate of the south east bin was locked out prior to entering silos for cleaning.

29 CFR 1910.272(j)(2)(ii): The employer did not immediately remove any fugitive grain dust accumulations whenever the exceeded one eighth inch (.32cm) at priority housekeeping areas, pursuant to the housekeeping program for grain elevators: a) Ottawa Grain and Feed Company, Inc. located at 206 South Oak Street in Ottawa, Ohio; On or about July 21, 2020 the employer did not ensure fugitive grain dust accumulations in excess of 1/8 inch thick was immediately removed. Accumulations of fugitive grain dust greater than 1/8 inch thick was observed in an enclosed room containing two roller-grinder mills.

Employees making batching and combining ingredients of feed are exposed to hazards associated with sodium bicarbonate and calcium carbonate such as, but not limited to, eye irritation, respiratory tract irritation/inflammation, and chemical pneumonitis.
