29 CFR 1910.178(l)(6): The employer did not certify that each operator has been trained and evaluated as required by this paragraph (l):  On or about 07/20/2020, at the Carriage House Apartments, Building #05 in the parking lot area, the employer exposed employees to struck-by hazards while operating a forklift truck, in that employees operating a JCB 510-56 All Terrain Forklift Truck without first receiving training and certifications to operate this equipment. Uncertified operators were in close proximity to others working on the roof and at ground level.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   On 07/20/2020, employees tasked with tearing off and installing asphalt roofing materials on a residential property located at the Carriage House Apartments, 810 Windy Hill Rd. (Apt. #05) were not protected from a fall hazard by conventional fall protection and/or devices. Employees were exposed to fall hazard from a height of approximately 16-feet, 3-inches from eave height to ground level.
