29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: On or about July 10, 2020, where employees were exposed to struck-by hazards while using an Accurshear shearing machine where the guard did not protect employees from placing hands beneath the hold downs.

29 CFR 1904.39(a)(2): The employer failed to report the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, within (24) twenty-four hours. On or about July 10, 2020 an employee was working on an Accurshear brand shear and placed his right hand underneath the hold downs as the machine actuated causing a crushing injury to his right pinky which resulted in an amputation. The employee was hospitalized without the employer reporting the incident to OSHA within 24 hours.
