29 CFR 1904.39(a)(2): Basic Requirement. Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA. a. On or about May 29, 2020, the employer failed to report to OHSA an employee's amputation that was the result of a work-related incident. An employee, working as a temporary worker, at the 9000 Smithville Road, Johnstown, Ohio 43031 worksite suffered a partial amputation of the right middle finger on May 28, 2020. The employer did not report the amputation to OSHA until July 10, 2020 when the employer submitted a report of the incident by phone.
