29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety. (a) Off Vaughn road on Pike road, Pike road, AL; On or about July 24, 2020 the employer exposed employees to cave-in hazards in that employees were allowed to work inside of a trench measuring six feet four inches deep on the Northside and five feet three inches deep on the Southside, nine feet four inches wide on the Northside and six feet five inches wide on the Southside and twenty six feet in length on both sides of the trench that was dug in class "b" soil. The superintendent was the designated competent person at the site and he allowed employees to work inside the trench without cave-in protection.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). (a) Off Vaughn road on Pike road, Pike road, AL; On or about July 24, 2020 the employer exposed employees to cave-in hazards in that employees were allowed to work inside a trench measuring six feet four inches deep and nine feet four inches wide on the Northside and five feet three inches deep and six feet five inches wide on the Southside and twenty six feet long on both sides of the trench that was dug in class "b" soil. The employer had not complied with the standard in that employees were not protected from cave-ins hazards by an adequate protective system.
