29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employees' ability to use a respirator, before the employee was required to use the respirator in the workplace: a) On or about 4/28/2020 and after, 320 W. Merrick Road, Freeport, NY: Employees including Registered Nurses, Licensed Practical Nurse's, Certified Nursing Assistant's, and Housekeepers were provided with, and required to wear, tight-fitting filtering facepiece N95 respirators, including, but not limited to, 3M brand, but were not provided with medical evaluations prior to use. Employees were required to use respirators when working around and providing care to patients suspected or confirmed to be infected with COVID-19. Abatement documentation is required for this item.
