OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees from being struck by material and falling racks.   a.  Tire Warehouse Area, rack location 100: On or about July 24, 2020, and at times prior, the employer exposed employees walking and operating powered industrial vehicles in the warehouse area to struck-by hazards, in that the employer did not ensure that the steel storage rack labeled 100 having bent/damaged supports was isolated until the damage was evaluated by a storage rack design professional and  was not placed into service until repaired.  b.  Tire Warehouse Area, rack location 800: On or about July 24, 2020, and at times prior, the employer exposed employees walking and operating powered industrial vehicles in the warehouse area to struck-by hazards, in that the employer did not ensure that the steel storage rack labeled 800 having bent/damaged supports was isolated until the damage was evaluated by a storage rack design professional and  was not placed into service until repaired.

29 CFR  1910.305(c)(4): Snap switches mounted in boxes did not have faceplates installed so as to completely cover the opening.  a.  Tire Warehouse North Wall, Battery Charging Area: On or about July 24, 2020, and at times prior, the employer exposed employees  to electrical hazards, in that the employer did not ensure that electrical conductors were guarded by an approved enclosure where a cover was not in place on an electrical box housing a snap switch used to operate overhead lights.

29 CFR 1910.36(d)(1): Employee(s) were not able to open an exit route door from the inside at all times without keys, tools, or special knowledge:  a.  Tire Warehouse Area North Wall, Receiving Area: On or about July 24, 2020, and at times prior, the employer exposed employees to hazards associated with fires and other emergencies, in that the employer secured the exit discharge door with a bar and did not remove the bar during working hours when employee were present.  b.  Tire Warehouse Area East Wall: On or about July 24, 2020, and at times prior, the employer exposed employees to hazards associated with fires and other emergencies, in that the employer secured the exit discharge door with a bar and did not remove the bar during working hours when employee were present.  c.  Wheel Warehouse Area East Wall: On or about July 24, 2020, and at times prior, the employer exposed employees to hazards associated with fires and other emergencies, in that the employer secured the exit discharge door with a bar and did not remove the bar during working hours when employee were present.  d.
