29 CFR  1903.19(c)(1): The employer did not certify to OSHA, within 10 calendar days after the abatement date, that the cited violation had been abated:  a) On or about 7/20/23:  The employer did not provide abatement certification for Citation 1, Item 001 for a violation of 29 CFR  1926.303(b)(1) where the employer allowed workers to use a DeWalt hand grinder without a guard installed over the cut off wheels to cut material.  An abatement demand letter was sent to the employer on May 23, 2023.     Abatement certification must be submitted for this item.

29 CFR  1926.303(b)(1):Grinding machines were not equipped with safety guards in conformance with the requirements of American National Standards Institute, B7.1-1970, Safety Code for the Use, Care and Protection of Abrasive Wheels, and paragraph (d) of this section.  a)  At the jobsite, on or about 7/24/20:  Workers used a DeWalt hand grinder to cut material where that grinder did not have a guard over the cut-off wheel.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  a) At the jobsite, on the roof, on or about 7/24/20:  Workers were installing a roof surface on a 6:12 pitch roof, with a ground to eave height of 20 feet, without fall protection of any kind.
