29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a) On July 23, 2020, a Bocanegra Construction LLC, employee fell 10 feet into a floor opening to the basement and suffered a concussion and multiple fractures on the neck, shoulder, ribs, and collar bones. The worker was not provided with a fall hazard training prior to working at the job site.  Abatement Note: Abatement certification and documentation is required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  a) On July 23, 2020, a Bocanegra Construction, LLC, employee fell 10 feet in a floor opening to the basement and suffered a concussion and multiple fractures on the neck, shoulder, ribs, and collar bones. The worker was not protected by a fall protection system while working beside the floor opening.  Bocanegra Construction, LLC, was previously cited for a repeat violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1419015, citation number 1, item number 1 and was affirmed as a final order on October 24, 2019, with respect to a workplace located at 16620 E. Virginia Ave. Aurora, CO 80012.  Bocanegra Construction, LLC, was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1406713, citation number 1, item number 1 and was affirmed as a final order on July 22, 2019, with respect to a workplace located at 10997 Ouray St. Commerce City, CO 80022.
