29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval: (a) Location - 42 Bessom Street, Marblehead, MA (Lumber Yard): On or about 07/31/2020, the Yale and Toyota forklifts are used with an attachment to pick and place lumber in the yard and the warehouse and the employer has not received approval from the manufacturers of these forklifts for the use of the attachment.

29 CFR 1910.178(a)(5): The powered industrial truck was equipped with front-end attachments other than factory installed attachments, however the employer did not request that the truck be marked to identify the attachments and show the approximate weight of the truck and attachment combination at maximum elevation with load laterally centered: (a) Location - 42 Bessom Street, Marblehead, MA (Lumber Yard): On or about 07/31/2020, the Yale and Toyota forklifts are used with an attachment to pick and place lumber in the yard and the warehouse and the forklifts have not been marked to identify the attachment and show the approximate weight of the truck and attachment combination at maximum elevation with the load laterally centered.

29 CFR 1910.178(m)(5)(i): When a powered industrial truck is left unattended, load engaging means were not fully lowered, controls were not netralized, power was not shut off, and brakes set: (a) Location - 42 Bessom Street, Marblehead, MA (Lumber Yard): On or about 07/31/2020, the forks of forklifts were left elevated and the forklift was unattended while the operator traveled to the second floor of the lumber warehouse to unload it.
