29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. a) On July 29, 2020, the employer failed to instruct employees on the safety protocols for identifying utility lines, in that the employer failed to utilize the 811 calling procedures for identifying utility lines, when in the South NGL terminal at Lone Star LLC Mont Belvieu facility, employees were permitted to perform Horizontal Directional Drilling without confirming or determining in advance the location and depth of all utilities and subsurface structures. This condition exposed employees to struck-by hazards from flying debris/shrapnel from a fire and explosion, when the boring tool struck an unidentified NGL pipeline.
