OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that the employer did not protect employees from the recognized hazard of struck-by:   a) On July 29, 2020, in the South NGL terminal at Lone Star LLC Mont Belvieu facility, employees were permitted to perform Horizontal Directional Drilling without confirming or determining in advance the location and depth of all utilities and subsurface structures. This condition exposed employees to struck-by hazards from flying debris/shrapnel from a fire and explosion, when the boring tool struck a 10-inch unidentified NGL pipeline.
