29 CFR 1926.1060(a)(1)(iii): The proper construction, use, placement, and care in handling of all stairways and ladders;    On or about August 6, 2020, at the previously addressed job site, the employer did not ensure the use of an appropriate ladder or other safe means of egress while employees were working to repair/replace a water line in a trench at a depth ranging from 5-6 feet.  Employees worked in the trench with a ladder laying on the ground outside of the trench which did not provide safe and immediate means of egress.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.      On or about August 6, 2020, at the previously addressed job site, the east side spoil pile was not at least 2 feet from the edge of the excavation.     There is no abatement certification or documentation required for this item.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c).       On or about August 6, 2020, at the previously addressed job site, workers were not protected by properly sloping the sides or using appropriate protective systems such as a trench box or shoring while working to repair/replace a section of water line in a trench at a depth ranging from 5-6 feet with vertical walls.     There is no abatement certification or documentation required for this item.
