29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: a. On or about April 23, 2020 and thereafter, at the Long Term Care 4th and 5th floors. The employer failed to establish and implement a written respiratory protection program with work-specific procedures for employees, including Registered Nurses (RNs), Licensed Practical Nurses (LPNs), Certified Nursing Assistants (CNAs) and housekeepers, who were required to wear tight-fitting N95 and KN95 respirators while performing job duties such as, but not limited to, providing care and housekeeping services to confirmed and suspected COVID-19 positive patients. On or about April 23, 2020 and thereafter, at the Long Term Care 4th and 5th floors. The employer did not select and provide a NIOSH-approved respirator to employees, including but not limited to Registered Nurses (RNs), Licensed Practical Nurses (LPNs), and Certified Nursing Assistants (CNAs), who provided direct patient care to residents suspected or confirmed to be infected with SARS-CoV-2 coronavirus. The employer required these employees to wear respirators labeled KN95 despite the availability of other alternative NIOSH-approved filtering facepiece respirators.
