The employer did not provide medical evaluations prior to requiring respirator use.

29 CFR 1904.39(a)(1): Within eight (8) hours after the death of any employee as a result of a work-related incident, the employer did not report the fatality to the Occupational Safety and Health Administration (OSHA), U.S. Department of Labor:  a) A nursing home staff member worked on and before 3/28/2020 at Cranbury Center, 292 Applegarth Road in Monroe Township NJ, providing direct nursing and personal care to patients known or suspected to have COVID-19, died on 4/13/2020.  Notification was not made to OSHA within 8 hours of the employer becoming aware of the work-related fatality on or about 4/14/2020.
