29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part. a. On or about July 8, 2020, the employer did not maintain a safety and health program to ensure hazards were identified and corrected onsite while performing stucco work on the front pillars of the building. Hazards included, but were not limited to, fall protection, aerial lift safety, use of hazardous chemicals, power tool safety, etc.

29 CFR 1926.453(b)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e). a. On or about July 8, 2020, an employee was exposed to falls from heights while working from an Aerial Boom Lift with no harness/body belt and lanyard attached to the aerial lift.
