29 CFR 1910.244(a)(1)(ii):  The rated load shall be legibly and permanently marked in a prominent location on the jack by casting, stamping, or other suitable means:    At the facility located at W6974 County Road OO, Fond du Lac, WI 54937; on or about July 23, 2020 and prior, hydraulic jacks used for lifting trucks and truck trailers were not legibly marked with the rated load of the equipment exposing Mechanic employees to potential caught-between/struck-by hazards if an undersized jack was used to lift heavy equipment.

29 CFR 1910.1200(e)(1):  Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met:  At the facility located at W6974 County Road OO, Fond du Lac, WI 54937; the employer did not implement a written hazard communication program when employees worked with hazardous chemicals including, but not limited to motor oils, greases, degreasers and cleaning solutions.  All provisions of 29 CFR 1910.1200(e) through (h) must be covered in a written hazard communication program. Key elements include, but are not limited to the following:  1)  Written program 2)  Complete SDS collection 3)  Labeled chemical containers 4)  Employee information and training

29 CFR 1910.1200(g)(8):  The employer shall maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and shall ensure that they are readily accessible during each work shift to employees when they are in their work area(s):  At the facility located at W6974 County Road OO, Fond du Lac, WI 54937; the employer did not have a safety data sheet (SDS) in the workplace for each hazardous chemical used when employees worked with hazardous chemicals including, but not limited to motor oils, greases, degreasers and cleaning solutions. Neither the employer nor employees knew where any SDS were located.  Note:  Electronic access and other alternatives to maintaining paper copies of the safety data sheets are permitted as long as no barriers to immediate employee access in each workplace are created by such options.

29 CFR 1910.1200(h)(3):  Employee training shall include at least the requirements of this section [29 CFR 1910.1200(h)(3)(i) through 29 CFR 1910.1200(h)(3)(iv):  At the facility located at W6974 County Road OO, Fond du Lac, WI 54937; the employer did not train employees on the methods and observations to detect the presence or release of hazardous chemicals in their work area; the physical, health, simple asphyxiation of chemicals in the work area; the measures employees can take to protect themselves from chemical hazards; or the details of the hazard communication program developed by the employer when the employees worked with hazardous chemicals including, but not limited to motor oils, greases, degreasers and cleaning solutions.  All provisions of 29 CFR 1910.1200(h)(3) include:  (h)(3)(i): Methods and observations that may be used to detect the presence or release of a hazardous chemical in the work area (such as monitoring conducted by the employer, continuous monitoring devices, visual appearance or odor of hazardous chemicals when being released, etc.)  (h)(3)(ii): The physical, health, simple asphyxiation, combustible dust, and pyrophoric gas hazards, as well as hazards not otherwise classified, of the chemicals in the work area  (h)(3)(iii): The measures employees can take to protect themselves from these hazards, including specific procedures the employer has implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices, emergency procedures, and personal protective equipment to be used  (h)(3)(iv): The details of the hazard communication program developed by the employer, including an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employees can obtain and use the appropriate hazard information

29 CFR 1910.132(d)(2):  The employer shall verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and, which identifies the document as a certification of hazard assessment:  At the facility located at W6974 County Road OO, Fond du Lac, WI 54937; the employer had determined which hazards where present in the workplace and what PPE was necessary to protect employees from those hazards. The employer did not verify through written certification which identified the workplace evaluated, the person certifying the evaluation or the date of the hazard assessment.
