29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns: (a) On or about August 12, 2020, a laborer employee on the ground level and working below three employees replacing plywood sheathing on an apartment building, was not provided a protective helmet. This exposed the laborer employee performing clean-up to a struck-by hazard to the head from the scrap plywood being thrown off the roof.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b): (a) On or about August 12, 2020, employees engaged in re-roofing of an existing apartment building, on an 8/12 pitched roof, were not protected from falling to the lower level. This exposed employees to a fall hazard of approximately 17 feet.
