29 CFR 1910.147(c)(6)(i)(A): The periodic inspection of the energy control procedure was not performed by an authorized employee other than the one utilizing the energy control procedure being inspected: (a) Machining Department - The authorized employee who performed the annual periodic inspection of the energy control procedure for the Whirlwind, model 212, cut-off saws was also the authorized employee who used the procedure, exposing employees to hazards, such as caught-in or struck-by moving parts, on or about August 13, 2020. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1910.147(d)(4)(i): Lockout or tagout devices were not affixed to each energy isolating device by authorized employees: (a) Machining Department - An employee had taken apart the Whirlwind, model 212, left hand cut-off saw, known as Saw #1, including taking off the front door/panel, exposing the operating parts inside the machine. The employee applied lockout/tagout to the electrical cord for this saw but did not lockout/tagout the pneumatic energy to the saw, exposing employees to hazards, such as caught-in or struck-by moving parts, on or about August 13, 2020. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1910.212(a)(3)(ii): Point of operation guards were not designed and constructed as to prevent the operator from having any part of their body in the danger zone during the operating cycle: (a) Machining Department - Employees used two Whirlwind, model 212, cut-off saws, known as Saw #1 and Saw #2, to cut long plastic boards into smaller uniform length pieces. These saws did not have complete point of operation guards in that both saws' clamp/guard assemblies were missing the front shields, exposing employees to contact with rotating saw blades, on or about August 11, 2020. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.
