The employer failed to establish and implement a written respiratory protection program for employees including Registered Nurses, Licensed Practical Nurses, Certified Nursing Assistants, and Housekeeping employees who provided care and services to suspected and confirmed COVID-19 positive residents. The employer provided and required the use of N95 respirators and respirators labeled KN95 at the facility. Violation occurred on or about 05/09/2020, and thereafter.

The employer did not provide NIOSH-certified respirators to employees who provided care and services to suspected and confirmed positive COVID-19 patients. The employer provided and required employees including, but not limited to Registered Nurses, Certified Nursing Assistants, Licensed Practical Nurses, and Housekeeping staff to wear respirators labeled KN95. However, the KN95 respirators were not used in compliance with the conditions of their certification in that they were not appropriately fit tested on employees. Violation occurred on or about on 5/09/2020, and thereafter. ABATEMENT DOCUMENTATION REQUIRED
