OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that hooks equipped with safety latches had their latches broken/inoperable. a) On or about 08/13/2020, at the second story stringer, a hoist hook connected to a pad eye had a broken safety latch. This condition exposed employees to struck by hazards. b) On or about 08/13/2020, at the third story stringer, a hook connected to the rigging equipment had a broken safety latch. This condition exposed employees to potential struck by hazards.

29 CFR 1926.251(e)(8): Synthetic web slings were not immediately removed from service if any of the following conditions specified in 1926.251(e)(8)(i) through (e)(8)(v) were present: (i) Acid or caustic burns; (ii) Melting or charring of any part of the sling surface; (iii) snags, punctures, tears, or cuts; (iv) broken or worn stitches; or (v) distortion of fittings. a) On or about 08/13/2020, at the stair way stringers that were being erected, slings used were charred on their synthetic surface and had slag imbedded into their synthetic webbing.
