29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s): On or about May 29, 2020, the employer failed to develop and implement an inspection process for a job site located at SRS 252 Columbia Road, Valley City, OH near mile marker 7, and designate a competent person who would be responsible for conducting these inspections. Inspections which would include the evaluation of potentially hazardous conditions at active work sites, to include but not limited to the safe operation of work vehicles, overhead line clearance, struck by and caught in between hazards.

Hazards, to include but not limited to, overhead lines with appropriate clearance and struck by hazards.

29 CFR 1926.601(b)(14): All vehicles in use were not checked at the beginning of each shift to assure that the following parts, equipment, and accessories were in safe operating condition and free of apparent damage which could cause failure while in use: service brakes, including trailer brake connections; parking system (hand brake); emergency stopping system (brakes); tires; horn; steering mechanism; coupling devices; seat belts; operating controls; and safety devices. On or about May 29, 2020, the employer failed to ensure that employees were completely filling out the DVIR (Driver Vehicle Inspection Report) prior to starting to operate the various CDL vehicles, to include but not limited to, the 2016 Peterbilt 567, 7 axle straight dump truck. Fully completing the DVIR's would help prevent something significant from being overlooked.
