29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: a) Rego Park N H LTD, 111-26 Corona Avenue, Flushing, NY, 11368: On or about May 6, 2020, and continuing thereafter, the employer failed to establish or implement a written respiratory protection program for employees who were required to wear N95 respirators. Employees including, Registered Nurses, Licensed Practical Nurses, Certified Nursing Assistants, Housekeeping and Maintenance employees were required to wear and wore N95 respirators while providing direct patient care and services to suspect or confirmed COVID-19 positive residents.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a) Rego Park N H LTD, 111-26 Corona Avenue, Flushing, NY, 11368: On or about May 5, 2020, and continuing thereafter, the employer required employees, including but not limited to Registered Nurses, Licensed Practical Nurses, Certified Nursing Assistants, Housekeeping and Maintenance employees to wear N95 respirators while providing direct patient care and services to suspected or confirmed COVID-19 positive residents. The employer did not provide medical evaluations to the employees before they were required to use the respirators.
