29 CFR 1926.403(i)(2)(i):Live parts of electric equipment operating at 50 volts or more were not guarded against accidental contact by cabinets or other forms of enclosures, nor by any of the means listed in subparagraphs (A) through (D) of this paragraph. a) Employees were exposed to electric shock hazard; there was an exposed live wire tip/terminal screw on the wall mounted light switch inside the doorway to the construction area, the elevator motor room (roof house); the light switch box did not have a cover and there was no tape over the live wire terminal screws. Location: 165 William St, NY NY 10038 On or about 8-13-2020 NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASEFILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION NOR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.

29 CFR 1926.405(g)(2)(iv):Flexible cords were not connected to devices and fittings so that strain relief is provided to prevent pull from being directly transmitted to joints or terminal screws: a) Employees were exposed to electric shock hazard due to damaged wiring; the metal conduit wire covering was separated exposing the inner wires to sharp edges/damage; on the fire alarm wiring located over the door to the elevator roof house. Location: 165 William St, NY NY 10038 On or about 8-13-2020 NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASEFILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION NOR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.

29 CFR OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the hazard struck by/crush hazard by an elevator which was not locked out. a) Employees were exposed to struck-by/ caught-by hazard from sudden start-up of the elevator machine (pulleys and cables) due to the elevator not being shut down or guarded during rebuilding of the elevator motor roof house. Location: 165 William St, NY NY 10038 On or about 8-13-2020
