29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: On April 15, 2020, through May 30, 2020, employees of Alden Valley Ridge Rehabilitation and Health Care Center, Inc. performed tasks such as feeding, bathing, maintaining continence, inserting and maintaining IVs, conducting assessments, and performing skin treatments for the residents of the Memory Care/Dementia Unit on the third floor, who had been identified as having contracted COVID-19. The employees were required to wear N95 respirators to protect from airborne biohazards. The employer did not implement a written respiratory protection program at the workplace with worksite-specific procedures for employees required to wear respirators, including but not limited to, a 3M 1870 N95 Health Care Particulate Respirator and Surgical Mask.

Employees were required to wear a 3M 1870 N95 Health Care Particulate Respirator and Surgical Mask during the performance of tasks such as feeding, bathing, maintaining continence, inserting and maintaining IVs, conducting assessments, performing skin treatments and other close patient interactions with residents who had been identified as having contracted COVID-19.
