(a) On or about August 5, 2020, and at times prior to that date, the employer did not document monitoring data to support either a detennination that its boot pits were not pennitrequired confined space or to support temporarily reclassifying the boot pits to non-pennit space, such that employees were exposed to potential health hazards when entering the boot pit for cleaning and other maintenance activities at 2472 30th Street NE in Gilby, North Dakota.

29 CFR 1910.272(g)(1)(ii): Prior to bin entry, all mechanical, electrical, hydraulic, and pneumatic equipment which presented a danger to employees inside grain storage structures in the grain handling facility were not disconnected, locked out and tagged, blocked-off, or otherwise prevented from operating by other equally effective means or methods:  (a) On or about August 4, 2020, and at times prior to that date, employees entering grain bins for cleaning and other maintenance activities at 24 72 30th Street NE in Gilby, North Dakota, were exposed to potential hazards when the employer failed to maintain adequate engineering controls to protect workers inside the bin from the sweep auger.

29 CFR 1910.272(g)(3): In the grain handling facility an observer, equipped to provide assistance, was not stationed outside the bin, silo, or tank being entered by an employee:   (a) On or about August 19, 2020, and at times prior to that date, employees entering grain bins for cleaning and other maintenance activities at 2472 30th Street NE in Gilby, North Dakota, were exposed to potential health and safety hazards when the employer failed to ensure that the individual tasked as an entry observer must focus solely on the observer responsibility at any time that an employee enters a bin containing grain at a level that presents an engulfment risk.
