29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee was using eye or face protection when exposed to eye or face hazards from flying particles. On or about August 20, 2020, and at times prior thereto, employees operating Hitachi nail guns while performing decking activities were not wearing eye protection, exposing employees to the hazard of being struck by flying objects.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: On or about August 20, 2020, and at times prior thereto, the employer did not ensure that employees engaged in decking activities were tied off or protected from fall hazards exposing the employees to unprotected fall hazards of approximately 11 feet to the ground below.
