29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person. On and about August 20, 2020, the employer did not ensure frequent and regular inspections of the jobsite were being performed with the intent of identifying and correcting unsafe conditions, including but not limited to the availability and use of PPE by all employees.

29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation. On August 20, 2020, an employee was exposed to eye injury while drilling holes into the concrete ceiling at the Sheboygan Falls Middle School apartment project when he was not wearing safety glasses and had none on the site.
