OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees from hazards associated with struck by hazards: a) At the workplace, on or about August 18, 2020, an employee in the process of loading marble slabs onto a delivery truck was exposed to a struck by hazard, in that, the employee worked in the fall shadow of the slab while a forklift set the slab onto an A-frame support.
