29 CFR 1910.147(c)(1): Energy control program. The employer shall establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative.  Seed warehouse, seed processing equipment - on or about August 21, 2020, the hazardous energy control "lockout tagout" program was not established in the workplace for servicing tasks performed by employees on equipment that was not safely de-energized. Employees had their hands exposed to machine caught-in hazards likely to result in serious injury when reaching into the point-of-operation and associated danger zone to remove jammed bags.  Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.176(b): Secure storage. Storage of material shall not create a hazard. Bags, containers, bundles, etc., stored in tiers shall be stacked, blocked, interlocked and limited in height so that they are stable and secure against sliding or collapse.  Seed warehouse: on or about August 21, 2020, employees working in the area and walking by the unstable three-tiered stack of palletized seed bags were exposed to struck-by and/or crushed-under hazards because load was not securely stored to prevent leaning, sliding, and collapsing.  There is no abatement documentation or certification required for this item.

29 CFR 1910.141(a)(5): Vermin control. Every enclosed workplace shall be so constructed, equipped, and maintained, so far as reasonably practicable, as to prevent the entrance or harborage of rodents, insects, and other vermin. A continuing and effective extermination program shall be instituted where their presence is detected.  Seed warehouse: on or about August 21, 2020, employees were exposed to mice infestation when handling palletized loads of seed bags. Implemented pest control program did not effectively exterminate rodents present in the warehouse and likely required additional efforts such as, but not limited to, increased number of baits, traps, and building maintenance and housekeeping efforts.  Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).  Forklifts and front-end wheel loaders with fork attachments: on or about Friday, August 21, 2020, employees assigned to operate forklifts and wheel loaders equipped with forks for material handling tasks did not receive complete initial operator training consisting of formal instruction and practical training in truck and workplace related topics, along with an evaluation in safe operation prior to being released for regular work duties.  Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  Seed warehouse, seed processing equipment - on or about August 21, 2020, the hazard communication program was not established in the workplace to provide for hazardous material labels and other forms of warning, accessible safety data sheets, and employee information and training related to all aspects of handling talc powder and treated seeds which exposed employees to respiratory difficulties and skin irritation.  Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
