29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. a) On August 20, 2020 at 3028 Quarry Park Drive in De Pere, Wisconsin, employees were working from a roof surface nineteen feet above surface level without utilizing fall protection equipment. b) On August 20, 2020 at 3028 Quarry Park Drive in De Pere, Wisconsin, an employee walked through a doorway onto a second floor patio with unprotected edges eleven and one half feet above surface level without utilizing fall protection equipment. The Jerry Zepnick Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1121873, citation number 02, item number 001 and was affirmed as a final order on April 25, 2016, with respect to a workplace located at 3017 Tri-Park Court; Appleton, WI 54914. The Jerry Zepnick Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1021553, citation number 01, item number 001 and was affirmed as a final order on April 20, 2015 with respect to a workplace located at Sunny Lane and Velp Avenue; Suamico, WI 54313.

29 CFR 1926.503(a)(2)(iii): The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used. On August 20, 2020 at 3028 Quarry Park Drive in De Pere, Wisconsin, the employer did not provide required fall protection safety training for an employee who did not associate fall from elevation hazard when working on a roof surface nineteen feet above surface level without utilizing fall protection equipment. The Jerry Zepnick Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.503(a)(2)(iii), which was contained in OSHA inspection number 1121873, citation number 01, item number 002 and was affirmed as a final order on April 25, 2016, with respect to a workplace located at 3017 Tri-Park Court; Appleton, WI 54914.
