29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  (a) C&C Welding and Fabrication, Inc., located at 1027 S. Lemay Ave., Fort Collins, CO 80525: On or before August 21,2020, the exposing employer did not develop, implement and maintain a written hazard communication program that pertains to employees use of chemicals such as, but not limited to: argon compressed gas, combustible fuels and oils and Dual Shield 710X, Flux Cored Wire. This condition exposed employees to chemical exposure hazards.   Note:  The requirements applicable to construction work under 29 CFR 1926.59 are identical to those set forth in 29 CFR 1910.1200.

Lemay Ave., Fort Collins, CO 80525: On or before August 21,2020, the employer did not ensure that safety data sheets were readily available to employees during each work shift when employees were working in a temporary location.  This condition potentially exposed employees to chemical hazards.    Note:  The requirements applicable to construction work under 29 CFR 1926.59 are identical to those set forth in 29 CFR 1910.1200.

29 CFR  1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:    (a) C&C Welding and Fabrication, Inc., located at 1027 S. Lemay Ave., Fort Collins, CO 80525: On or before August 21,2020, the employer did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trained about is introduced into their work area, such as but not limited to the following chemicals: argon compressed gas, combustible fuels and oils and Dual Shield 710X, Flux Cored Wire. This condition exposed employees to chemical exposure hazards.   Note:  The requirements applicable to construction work under 29 CFR 1926.59 are identical to those set forth in 29 CFR 1910.1200.

29 CFR 1926.300(b)(1): Power operated tool(s), designed to accommodate guards, were not equipped with such guards when in use:  (a) C&C Welding and Fabrication, Inc., located at 1027 S. Lemay Ave., Fort Collins, CO 80525:  The exposing employer did not ensure that the hand held, Dewalt, paddle switch, small angle grinder was equipped with the guard that was designed by the manufacturer. This condition exposed employees to the hazard of being struck by shrapnel in the event of a grinding wheel failure.

29 CFR 1926.351(b)(4): Weld Power Cables in need of repair were used. When a cable, other than the cable lead referred to in paragraph (b)(2) of this section, becomes worn to the extent of exposing bare conductors, the portion thus exposed shall be protected by means of rubber and friction tape or other equivalent insulation.  (a) C&C Welding and Fabrication, Inc., located at 1027 S. Lemay Ave., Fort Collins, CO 80525:  On or before August 21, 2020, the employer did not ensure that weld power cables providing electrical current to the Lincoln Electric, Model LN-25 Wire Feeder, Portable Welder were protected by means of rubber and friction tape or other equivalent insulation.  The power cables had exposed, bare copper wire that was providing power from the work truck generator on the ground level to the wire feeder on 3rd level of the stairwell in the parking garage.  Employees were potentially exposed to electrical shock hazards.
