29 CFR 1910.28(b)(1)(i): The employer did not ensure that each person on a walking-working surface with an unprotected side or edge that was 4 feet or more above a lower level was protected from falling by one or more of the following: a guardrail system, a safety net system or use of personal fall protection system, such as personal fall arrest, travel restraint or positioning system: (a) Maintenance bay: On or about 8/21/2020, the employer did not ensure that a worker on a truck-mounted metal deck, approximately 9' 2" in height, was protected from falling to the ground, in that the employee used a portable metal stairway to access the metal deck and perform work without any form of fall protection.
