On or about August 22, 2020, employees engaged in recycling operations were exposed to struck-by hazards due to the operator using a forklift prior to first being evaluated as required after being involved in an accident; to ensure that the operator had the knowledge and skills needed to operate the powered industrial truck safely.

29 CFR 1910.178(o)(1): The employer did not ensure that only stable or safely arranged loads were handled: On or about August 22, 2020, employees engaged in recycling operations were exposed to struck-by and caught-between hazards due to the forklift operator lifting an unstable load with a forklift. The unstable load tipped over and struck an employee while standing next it.
