29 CFR  1910.1200(e)(1):Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes the following:  a. At the Emerald Isle Resort Condominium Association, Inc. property, on or about August 26, 2020, the employer had not developed, implemented or maintained a written hazard communication program which consists of SDS sheets, labeling of the chemicals and employee training.  Employees used various chemicals daily such as but not limited to: Chlorinated tablets, free style stabilizers, muratic acid, WD-40, Round-Up, Ortho Home defense, spray paint and Sodium bicarbonate, exposed to blindness, respiratory issues and irritation to the eyes.

At the Emerald Isle Resort Condominium Association, Inc. property, on or about August 26, 2020, the employer did not ensure all bottles were properly labelled as to their contents, exposing employees to possible respiratory issues, blindness and eye and skin irritations.

At the Emerald Isle Resort Condominium Association, Inc. property, on or about August 26, 2020, the employer did not have  SDS sheets for employees using various chemicals on a daily basis such as but not limited to: Chlorinated tablets, free style stabilizers, muratic acid, WD-40, Round-Up, Ortho Home defense, spray paint and Sodium bicarbonate, exposed to blindness, respiratory issues and irritation to the eyes.

At the Emerald Isle Resort Condominium Association, Inc. property, on or about August 26, 2020, the employer had not developed, implemented or maintained a written hazard communication program which consists of SDS sheets, labeling of the chemicals and employee training. At the Emerald Isle Resort Condominium Association, Inc. property, on our about August 26, 2020, the employer exposed employees to struck-by and crushing  hazards, in that employees were allowed to operate a forklift vehicle without the successful completion of powered industrial truck training and evaluation.
