29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems:  (a) 2934 Routt Circle, Lakewood CO 80215: On or about September 1, 2020, Gollnick Construction, Inc. d/b/a Colorado Excavating did not ensure that employees working inside a trench with near vertical walls were protected from cave-in or collapse.  Employees were working in a trench approximately 10 feet deep which curved around a tree.  The employer provided a protective shoring system which could not fit in the curve of the trench.  The person assigned to perform daily inspections did not identify and provide an adequate protective system.  The same person could not consistently identify the soil type during the inspection.   Note: "Competent person" means one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authorization to take prompt corrective measures to eliminate them.  Abatement Note: Abatement certification and documentation are required for this item (see enclosed Certification of Corrective Action Worksheet).  Gollnick Construction, Inc. d/b/a Colorado Excavating was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1326963, citation number 1, item number 1, group a and was affirmed as a final order on October 9, 2018, with respect to a workplace located at 1615 Osceola St, Denver, CO 80204.

Employees dug two trenches approximately 10 feet deep replace a sewer line at a residential location.  There were no protective systems such as sloping, shoring, or shielding in place when employees were working in trenches.
