29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation. On or about August 24, 2020, during the relocation of a sanitary and water line pipe at a jobsite located at State Route 20 and State Route 45, Ashtabula, Ohio the employer did not ensure an employee used a face shield to protect his face against flying particles and other struck-by hazards while cutting a ductal iron water pipe with a Hilti, Model DSH 900 gas powered cut-off saw.
