29 CFR  OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees where an unsecured load of windows was not secured to prevent it from falling out of a job made forklift attachment bin:  a) Summer Hill Multi-Family Apartments located at 565 Hank Aaron Drive, Atlanta, GA 30315, First level parking deck: On September 2, 2020, employees were exposed to crushing and struck-by hazards while window units were being transported inside a job-made forklift attachment.

29 CFR  1926.21(b)(2):The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to his work environment to control or eliminate any hazard(s) or other exposure to illness or injury:  Summer Hill Multi-Family Apartments located at 565 Hank Aaron Drive, Atlanta, GA 30315, First level parking deck: On or about September 2, 2020, the employer did not train each employee in the hazards related to forklifts and safe places to walk in and around moving equipment. An employee was walking in close proximity to a forklift truck with an unsecured load and was struck-by the load when the employee spotting the forklift operator in the fall zone.

29 CFR  1926.602(c)(1)(ii): Modifications or additions which affect the capacity or safe operation of the equipment were made without the manufacturer's written approval:   Summer Hill Multi-Family Apartments located at 565 Hank Aaron Drive, Atlanta, GA 30315, First level parking deck: On or about September 2, 2020, a forklift truck was used to lift and transport window units in a job-made wood constructed bin exposing employees to potential struck-by hazards, in that the wooden bin attachment used was not approved by the manufacturer of the telehandler.
