Bortnick Dairy, LLC., Various areas throughout the farm, on or about September 2nd, 2020 and times prior thereto: Employees worked with and around hazardous substances including, but not limited to, formaldehyde, diesel fuel, and iodine during dairy farming operations onsite. A written hazard communication program had not been developed and implemented. ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below). This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.

The employer did not provide hazard communication training for all employees who worked with and around hazardous substances. 29 CFR 1928.57(c)(2)(i): The mesh or nip-points of all power driven gears, belts, chains, sheaves, pulleys, sprockets and idlers were not guarded: A.) Bortnick Dairy, LLC., Dry barn manure pit area, on or about September 2nd, 2020 and times prior thereto: Employees were exposed to caught-in hazards while working with/around the power transmission components associated with the manure pit agitation system. The chain and sprocket and belt and pulley associated with the power transmission of the farmstead equipment were not guarded to protect employees from potential caught-in hazards.
