29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:  On or about September 2, 2020 an employee entered a 4.8 foot deep trench without a safe means of access, exposing the employee to the hazards associated with no safe access.   Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1926.651(d): Employees exposed to public vehicular traffic were not provided with a warning vest or other suitable garments marked with or made of reflectorized or high-visibility material:   On or about September 2, 2020 employees working in and around the roadway were not wearing high-visibility garments, exposing employees to struck-by hazards.   Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.  On or about September 2, 2020 an employee entered a 4.8 foot deep trench where the spoil pile was not placed two feet from the excavation edge, exposing the employee to struck-by hazards.  Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).

Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).
