29 CFR OSH ACT of 1970 Section (5)(a)(1):Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were working in close proximity to each other and were exposed to SARS-CoV-2, the virus that causes Coronavirus Disease 2019 (COVID-19): On or about August 12, 2020, employees working on the Fabrication Floor worked in close proximity to each other during the COVID-19 pandemic. These conditions increased the risk of exposure to COVID-19 at the facility. As of August 25, 2020, the employer had 72 total positive tests out of approximately 125 employees.
