Employees were engaged in sheathing operations without the use of a fall protection system. This condition exposed employees to a fall hazard of approximately 9 to 20 feet.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: (a)AA Drywall and Painting, LLC at 164 &166 24th Street, Huron, SD 57350: On or about and at times prior to September 3, 2020, the employer did not ensure that employees engaged in framing and sheathing operations on a multi-family residence, had been trained to recognize the hazards associated with working at elevations over 6 feet. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. Employees working on-site had not received fall protection training before working at elevations over 6 feet.

29 CFR 1926.1053(b)(13): The top or top step of a stepladder was used as a step: (a)AA Drywall and Painting, LLC at 164 &166 24th Street, Huron, SD 57350: On or about and at times prior to September 3, 2020, the employer did not ensure employees were protected from falls associated with utilizing the top step of an A-frame step ladder as a step. Employees were using the top step to gain access to the top plates. This condition exposed employees to a fall hazard of approximately eight feet.

The condition exposed employees to the hazard of falling approximately 8 feet.
