29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  (a)AA Drywall and Painting LLC at 164 &166 24th Street, Huron, SD 57350: On or about and at times prior to September 3, 2020, the employer did not ensure that employees conducting framing operations on a residential home were protected from falls. Employees were engaged in sheathing operations without the use of a fall protection system. This condition exposed employees to a fall hazard of approximately 9 to 20 feet.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  (a)AA Drywall and Painting, LLC at 164 &166 24th Street, Huron, SD 57350: On or about and at times prior to September 3, 2020, the employer did not ensure that employees engaged in framing and sheathing operations on a multi-family residence, had been trained to recognize the hazards associated with working at elevations over 6 feet. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. Employees working on-site had not received fall protection training before working at elevations over 6 feet.

29 CFR 1926.1053(b)(13): The top or top step of a stepladder was used as a step:  (a)AA Drywall and Painting, LLC at 164 &166 24th Street, Huron, SD 57350: On or about and at times prior to September 3, 2020, the employer did not ensure employees were protected from falls associated with utilizing the top step of an A-frame step ladder as a step. Employees were using the top step to gain access to the top plates. This condition exposed employees to a fall hazard of approximately eight feet.

29 CFR 1926.1060(a): The employer did not provide a training program for each employee using ladders and stairways, as necessary, which would enable each employee to recognize hazards related to ladders and stairways and train each employee in the procedures to be followed to minimize these hazards:  (a)AA Drywall and Painting, LLC at 164 &166 24th Street, Huron, SD 57350: On or about and at times prior to September 3, 2020, the employer did not ensure that employees utilizing ladders had been trained to recognize the hazards associated with working with and on ladders. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. The condition exposed employees to the hazard of falling approximately 8 feet.
