29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use.  On or about September 2, 2020, employees were exposed to respiratory hazards while wearing half-facepiece and full-facepiece respirators while painting products without the employer having an established written respiratory protection program.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace.   On or about September 2, 2020, employees in the paint area were exposed to respiration hazards while wearing a 3M brand half-facepiece respirator without having been medically evaluated.

29 CFR 1910.134(f)(2): The employer did not ensure that an employee using a tight-fitting facepiece respirator was fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter  a.  On or about September 2, 2020, employees in the paint area were exposed to respiratory hazards while wearing a half-facepiece respirator or full-facepiece respirator without having been fit tested before initial use.  b.  On or about September 2, 2020, an employee in the paint area was exposed to respiratory hazards while wearing a half-facepiece respirator without having been fit tested annually.

29 CFR 1910.134(g)(1)(i)(A): Respirators with tight-fitting facepieces were worn by employees who had facial hair that came between the sealing surface of the facepiece and the face or that interfered with valve function.  On or about September 2, 2020, employees were required to wear tight fitting 3M brand half-face and full-face respirators without having their facial hair trimmed or shaven so that the facial hair did not interfere with the face and mask sealing surface.
