29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury employees were exposed to struck by hazards from kickback of a cut-off saw: a) 1319 New Loudon Road, Cohoes N.Y. , On or about September 4, 2020; The incorrect tool and blade was used when a Stihl Cut-Off Model #TS-420 with a carbide-tipped blade was used to cut pipes made of High Density Polyethylene (HDPE).

OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards associated with improper use of a cut-off saw during cutting operations: a) 1319 New Loudon Road, Cohoes, NY - on or about September 4, 2020, , the employer failed to train employees on the proper selection and use of tools to be used during their work on the job. Employees did not have training on the correct tool and blade to use to perform the cutting of the HDPE pipe . Employees used a Stihl Model #TS-420 Cut-off Saw with a carbide tipped blade to cut the pipe.
