29 CFR  1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  Steel Valley Portable X-Ray Service working at St. Joseph Care Center dba St. Joseph Senior Living located at 2308 Reno Avenue, Louisville, Ohio 44641  On or about September 11, 2020 and at times thereafter, the employer did not provide a medical evaluation to determine each employee's ability to use a N95 respirator before requiring the use. The employees were required to wear N95 respirators while exposed to suspected or confirmed positive COVID-19 residents.

29 CFR  1910.134(f)(2):Employee(s) using tight-fitting facepiece respirators were not fit tested prior to initial use of the respirator:  Steel Valley Portable X-Ray Service working at St. Joseph's Senior Living Center located at 2308 Reno Drive, Louisville, OH 44641:  On or about September 11, 2020 and at times thereafter, the employer did not provide a fit test to all employees required to wear N95 respirators. The employees were required to wear N95 respirators while exposed to suspected or confirmed positive COVID-19 residents.

29 CFR  1910.134(k)(3): Training was not provided prior to requiring employees to use a respirator in the workplace:  Steel Valley Portable X-Ray Service working at St. Joseph Care Center dba St. Joseph Senior Living Center located at 2308 Reno Ave, Louisville, Ohio 44641:  On or about September 11, 2020 and at times thereafter, the employer did not provide employees required to wear N95 respirators to protect against exposure to the SARS-CoV-2 virus with training in the use, cleaning, and storage of a respirator, before requiring their use. The employees were required to wear N95 respirators while exposed to suspected or confirmed positive COVID-19 residents.
