29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. a. On or about August 27, 2020, the employer had not provided sufficient training for employees conducting gutter work. The workers were walking through an area where roofing work was conducted overhead. The workers were not wearing protective helmets. The debris was coming down from the roof and the two employees were exposed to being struck by roofing debris and tools falling from the roof. ABATEMENT CERTIFICATION IS REQUIRED

29 CFR 1926.100 (a) Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets: a. On or about August 27, 2020, employees were not wearing protective helmets when conducting gutter work around and walking below an area where a roofer performed work without fall protection. Debris was being blown off the roof and the two employees were exposed to being struck by roofing debris, worker and tools falling from the roof. ABATEMENT CERTIFICATION IS REQUIRED
